The Clerk of the Court & Comptroller of Lee County, Florida is currently holding approximately $100,000 in unclaimed funds.
These funds are outstanding checks that have not cleared the bank because they have been lost or destroyed and may be reissued. The Clerk’s office will verify that the funds have not been paid prior to reissuing a check. There is a 30 day waiting period after a check has been issued before you can request a reissue. A check will not be reissued if the funds have been paid from the bank. Checks will only be reissued to the original owner of the funds.
Checks dated more than six months old are no longer payable. They may be reissued to the original owner of the funds. The most current lists of State dated checks can be found at https://www.leeclerk.org/records/unclaimed-monies
If unclaimed funds have not been claimed for more than a year, they are turned over to the state in accordance to Florida Statute 717, Disposition of Unclaimed Property. To request a check to be reissued you must provide the following documentation for verification purposed when filing a request. Failure to do so will result in a denial of the request.
For Individuals:
- For Unclaimed Funds: Original notarized Claim Form
- For Cash Bond Redemption: Original notarized Affidavit of Certification for Cash Bond Redemption
- Copy of drivers license or government issued ID card
- Verification of address
- If you are not the owner of the funds you will need a notarized Power of Attorney to act on behalf of the owner
For Businesses:
- Original, notarized Unclaimed Funds Claim Form
- Copy of W-9 with FEIN and current business address
- Original Letter of Authorization on company letterhead with the names of those authorized to sign on behalf of the business
- Copy of drivers license or government issued ID card
- Merger agreement if you company has merged with another company
- Articles of dissolution if your company was dissolved
